ضمان المنتوج وتنفيذ خدمة ما بعد البيع للمستهلك المادي والافتراضي حقا أساسيا يضمنه القانون Product Assurance And Implementation Of A Post-sale Service For The Physical And Virtual Consumer A Fundamental Right Guaranteed By Law

الملخص
مـــــــلــــــخـــــــص من أبرز حقوق المستهلك التي سعت مختلف التشريعات إلى حمايتها، حقه في ضمان صلاحية المنتوج للاستعمال المخصص له ومطابقته للمواصفات المتفق عليها في العقد طيلة فترة الضمان، وتوفير خدمة ما بعد البيع بالحفاظ على مواصفات المنتوج وصلاحيته بعد انقضاء هذه الفترة. حرصا من المشرع الجزائري على تجسيد هذا الالتزام، تم إصدار قانون جديد خاص بحماية المستهلك وقمع الغش يتمثل في القانون رقم 09ــ03 المعدل والمتمم، الذي عزز من أحكام الضمان وأقرنه بإجراء جديد هو الالتزام بتنفيذ خدمة ما بعد البيع. وبعد صدور المرسوم التنفيذي رقم 13ــ327 المحدد لشروط وكيفيات وضع ضمان السلع والخدمات حيز التنفيذ أصبح الضمان وخدمة ما بعد البيع من النظام العام فلا يمكن للمتعاقدين الاتفاق على مخالفتهما أو إسقاطهما. ومع اتساع مجال التجارة الإلكترونية في الجزائر نص المشرع الجزائري في القانون رقم 18ـ05 المتعلق بالتجارة الإلكترونية على وجوب أن يقدم المورد الإلكتروني في عرضه التجاري شروط الضمان وخدمة ما بعد البيع، كما توج التعديل الدستوري لسنة 2016 و2020 بإدراج حق المستهلكين في الحماية ضمن الحقوق الأساسية المضمونة دستوريا. وهكذا أصبح ضمان صلاحية المنتوج وتنفيذ خدمة ما بعد البيع من الحقوق المضمونة قانونا التي يجب على المتدخل الالتزام بها وتنفيذها. Abstract: One of the most prominent consumer rights that various legislation has sought to protect is the right to ensure that the product is suitable for its intended use and meets the specifications agreed in the contract for the duration of the warranty, and to provide a post-sale service by maintaining the product's specifications and validity after the expiration of the period. The Algerian legislature has enacted a new law on consumer protection and the suppression of fraud, amended and supplemented by Act No. 09 03. With Executive Decree No. 13,327 establishing the terms and modalities of the security of goods and services in force, the guarantee and the post-sale service are from the public order. With the expansion of electronic commerce in Algeria, the Algerian legislator stipulated in Act No. 18-05 on electronic commerce that the electronic supplier must provide security and post-sale service conditions in its commercial offer, and the constitutional amendment of 2016 and 2020 incorporated the right of consumers to protection into the constitutionally guaranteed basic rights. Thus, ensuring the viability of the product and implementing a post-sale service has become a legally guaranteed right to which the accomplice must be bound and executed.
