الملخص
شهد النظام القانوني لضبط النشاط الاقتصادي في المجال المنجمي تطورا ملحوظا من خلال إنشاء الوكالة الوطنية للممتلكات المنجمية، و الوكالة الوطنية للجيولوجيا و المراقبة المنجمية سنة 2001 كسلطتين إداريتين مستقلتين، تملك كل كل واحدة منهما اختصاصات مستقلة عن الأخرى في ضبط ومراقبة الأنشطة المنجمية بما يتوافق مع الشروط الإجرائية والتقنية المنصوص عليها في القانون. وقد تغيرت الطبيعة القانونية للوكالتين بصدور قانون جديد ينظم هذا المجال سنة 2014 لتنشأ بموجبه وكالتان تشكلان امتدادا لسابقتيها، تتمتعان بالشخصية القانونية والاستقلال المالي، كما لا تخضعان للقواعد المطبقة على الإدارة مما جعلها تتصف بالطابع التجاري والصناعي. كل هذا يدفعنا للبحث في أثر انعكاس هذا التطور القانوني على ضبط النشاط الاقتصادي في المجال المنجمي ومدى مسايرة نصوصه للتطور المتسارع لهذا النشاط. : The legal system for controlling economic activity in the mining field has witnessed a remarkable development through the establishment of the National Agency for Mining Properties and the National Agency for Geology and Mining Control in 2001 as two independent administrative authorities, each with independent competencies in controlling and monitoring mining activities in accordance with the conditions Procedural and technical stipulated by law. The legal nature of the two agencies has changed with the issuance of a new law regulating this field in 2014 to establish two agencies that constitute an extension of its predecessors, enjoying legal personality and financial independence, and are not subject to the rules applicable to management, which made them characterized by a commercial and industrial nature. All this prompts us to discuss the impact of this legal development’s reflection on controlling economic activity in the mining field and the extent to which its texts keep pace with the rapid development of this activity.
