اختصاص مجلس الأمن في مكافحة القرصنة البحرية

الملخص
كَثُر الحديث في السنوات الأخيرة عن أسباب تفاقم أعمال القرصنة البحرية والسطو المسلح قبالة سواحل الصومال وفي خليج عدن، وعن التداعيات التي نتجت على الانتشار الواسع لهذه الأنشطة البحرية غير المشروعة على مختلف الأصعدة وبالرغم من وجود بعض النصوص القانونية الدولية المحاربة لظاهرة القرصنة البحرية، إلا أنها لم تفِ بالقضاء على هذه الظاهرة أو التخفيف منها، ولأنه ثمة قصوراً شديداً ينتاب النصوص القانونية الدولية، فقد أصدر مجلس الأمن الدولي في السنوات القليلة الماضية جملة من القرارات، كيف من خلالها أنشطة القرصنة والسطو المسلح على السفن قبالة السواحل الصومالية على أنها أنشطة تشكل خطرا وتهديدا للسلم والأمن الدوليين، ورخص بموجب القرار1816(2008) للقوات العسكرية الأجنبية العاملة بالمنطقة بتتبع القراصنة حتى داخل المياه الإقليمية الصومالية من أجل مكافحة هذه الأنشطة البحرية غير المشروعة، وألزم هذه القوات الأجنبية بالتقييد بجملة من الشروط لبسط الشرعية على عمليات المكافحة التي يقومون بها داخل هذه المياه Abstract: In recent years, there has been much talk about the reasons for the worsening of maritime piracy and armed robbery off the coast of Somalia and in the Gulf of Aden, as well as the outbreaks that resulted from the widespread spread of these illegal maritime activities at various levels. Despite the existence of some international legal laws fighting the phenomenon of maritime piracy, they were unable to eliminat or mitigate this phenomenon. Due to the fact that there are severe shortcomings in international legal laws, the Unied Nation Security Council has issued in the past few years a number of resolutions, describing the activites of piracy and armed robbery on ships off the Somali coast as activities that pose a threat and endangers the international peace and security.They have also issues licenses under resolution 1816(2008) for foreign military forces operating in the region to track pirates even inside Somali terrtorial waters in order to combat these illegal maritime activities.They mandated these foreign forces to stick to a number of condition in order to extend legitimacy to the combat operations they carry out inside these waters.
