العلاقة بين السلطات في حالة النظام البرلماني

الملخص
يهدف هذا البحث والذي بعنوان (العلاقة بين السلطات في حالة النظام البرلماني إلى توضيح العلاقة بين السلطات الثلاث التشريعية والتنفيذية والقضائية) في حالة النظام البرلماني. وكان سبب اختيار الباحث لهذا الموضوع لأهمية العلاقة بين السلطات الثلاث في حالة النظام البرلماني وتتمثل مشكلة البحث في الدور الذي يلعبه النظام البرلماني في تحديد الدور الذي تلعبه كل سلطة مع إستغلالها لوحدها . كما تكمن للبحث مشكلة أخرى تمثلت في كيفية التوازن بين هذه السلطات أتبع الباحث في كتابة هذا البحث المنهج الاستقرائي التحليلي، وكذلك المنهج التاريخي . وأقتضت طبيعة البحث أن يقسم إلى ثلاثة مباحث، المبحث الأول بعنوان (المفهوم التقليدي للعلاقة بين السلطتين التشريعية والتنفيذية في النظام البرلماني) . أما المبحث الثاني بعنوان (توضيح العلاقة بين السلطات الثلاث في حالة النظام البرلماني) والمبحث الثالث فبعنوان (التطبيق العملي بين السلطات الثلاثة في حالة النظام البرلماني) . حيث كانت أهم النتائج أن النظام البرلماني يفتقد التعاون المشترك بين هذه السلطات وكانت أهم التوصيات أن يهتم النظام البرلماني بالسلطات الثلاث حتى تقوم كل واحده بدورها على الوجه الأكمل. وختاماً ذيل البحث بفهرس المصادر والمراجع . This research which entitles “The Relation Between the Authorities in the case of the Parliament System in Clarifying the Relation Between the Three Authorities: Legislature, Executive, and the Judicial” in the case of the Parliament System. The researcher has chosen this topic for its significance among these three authorities in the case of the Parliament system. The research problem lies in the role that the Parliament system plays in determining the role which each authority plays on its own, and also another problem lies in the balancing between these authorities. The researcher adopted in this study the inductive analytical approach and also the historical approach. The nature of the research obliged that it should be divided into three sections (parts). The first is entitled “The traditional concept to the relation between the executive and the legislative authorities in the Parliament system”. The second is entitled “The clarification of the relation between the three authorities in case of the Parliament system”. The third one is entitled “The practical application between the three authorities in case of the Parliament system” The most important result of the study is that the Parliament system lacks the shared cooperative effort between these authorities. The researcher then recommended that: the Parliament system should care for three authorities so that each one should take its role as it is supposed to be. In the end the study is Concluded with a list of references
