الملخص
يعتبر الفساد ظاهرة متعددة الجوانب بالنظر لتعدد صوره ومظاهره التي أخذت تتجاوز حدود الدولة الواحدة ، لتصبح ظاهرة دولية عالمية لم يعد من الممكن التعامل معها من خلال الإجراءات الوطنية فقط ، خاصة في ظل التقدم العلمي والتكنولوجي الهائل . فهو ظاهرة تمس عدة قطاعات بما فيها القطاع العام خاصة ما يتعلق بالصفقات العمومية على اعتبار أنها عقود ممولة من ميزانية الدولة مما يجعلها عرضة للتجاوزات بشتى الوسائل بغرض تحقيق المصالح الخاصة. كما يؤدي إلى منحها لمن لا يستحقها من جهة ومن جهة أخرى الغش في تنفيذها وبالتالي يتم هدر المال العام وزيادة تكلفة المشاريع بالإضافة إلى سوء الإنجاز وانعدام الجدوى الإقتصادية وسوء الخدمة العمومية وعدم القدرة على توفير الخدمات الأساسية للمجتمع. الكلمات المفتاحية : الفساد ، الصفقات العمومية ، القطاع العام ، الدولة. Abstract : Corruption is a multifaceted phenomenon in view of the multiplicity of its forms and manifestations that have taken beyond the borders of one country, to become a global international phenomenon that can no longer be dealt with through national procedures only, especially in light of the tremendous scientific and technological progress. It is a phenomenon that affects several sectors, including the public sector, especially with regard to public deals, on the grounds that they are contracts financed from the state budget, making them vulnerable to abuse by various means in order to achieve private interests. It also leads to granting it to those who do not deserve it on the one hand, and on the other hand, fraud in its implementation, and thus public money is wasted and the cost of projects increases, in addition to poor achievement, lack of economic feasibility, poor public service, and the inability to provide basic services to the community.
