الملخص
يُعدُّ البحث في النظام القانوني للخَوصصة عَملا بَحثيًا جِدُّ هامّ في مجال الدِراسات القَانُونية المُقارنة في ظلّ تَداعياتِ جائحة كورونا كوفيد-19 وتفرّعاتها، الظّاهـرة مِنها والخفيّـة، وآثارِها السلبـيَّة المُباشِرة على الأداةِ الإنتاجِيَّة والصِّناعِيَّةِ والخدمِيَّة العُمومِيَّة منها والخاصَّة. ويَتحدّدُ الهدفُ مِن هذا البحثِ في اقتراحِ مُقاربةٍ قانُونِيَّةٍ واقتِصَّادِيَّةٍ واجتِماعِيَّةٍ جدِيدَة، قد يكونُ مِن شأنِها تكريسُ مفاهِيمَ جدِيدةً أكثرَ عقلانِيَّةٍ وفاعِليَّة للخوصَصة، بعيدًا عن النّظرَة "الدّ وغماتية" التي أفشلتْ تجربةَ الخوصصة في بلادِنا، وحالت دُون تحقيقِ الأهدافِ الاقتصاديَّةِ و التّجاريَّةِ والصِّناعيَّة التي حدّدتها السُّلطاتُ العمومِيَّة لبرنامجِ الهيكلةِ والتّثبِيتِ الهيكلِي منذُ سنة 1989. Abstract: The research on the legal system of privatization is a scientific research work of great importance in the field of comparative legal studies and this, in the light of the repercussions of the Corona Covid-19 pandemic and its apparent and hidden ramifications and its consequences direct and indirect negative and devastating effects on the public and private work tool, employment and business survival. The object of this legal study (the third way) is part of a new legal, economic and social approach to social order privatization including more rational, useful concepts that comply with the constitutional principles in force, in order to overcome the received, dogmatic, sterile and fixed ideas that the process of privatization in our country has known and which has prevented the achievement of the economic, commercial and industrial objectives set for a privatization controlled by the public authorities and this, since 1989. .
