الحماية الجزائية للتصاميم الشكلية للدوائر المتكاملة في التشريع الجزائري

الملخص
الملخص: كان للتقدم الصناعي الناتج عن التطور العلمي والتكنولوجي أثره البارز في ظهور التصاميم الشكلية للدوائر المتكاملة، الأمر الذي جعلها عامل أساسي لتعزيز القدرات الصناعية للدولة، ونظرا لأهميتها في تنظيم العلاقات الاقتصادية، كان لزاما على الدول المتقدمة إيجاد نظام تشريعي يكفل حماية هذه التصاميم الشكلية ويساهم في تطوير مجال الصناعة والتجارة. فحماية حق المبتكر من شأنه دفع عجلة الابتكار للوصول إلى تصاميم شكلية جديدة تؤدي إلى خلق مشاريع اقتصادية تساهم في ازدهار التجارة. تتمتع التصاميم الشكلية للدوائر المتكاملة كغيرها من حقوق الملكية الصناعية بحماية جزائية تتخذ شكل دعوى التقليد، حيث يعد حسب الأمر 03-08 أي مساس بالحقوق المترتبة عن هذا التصميم جنحة تقليد. ولدراسة الحماية الجزائية، فإنه من المناسب أولا عرض مفهوم التصاميم الشكلية للدوائر المتكاملة الذي يغلب عليه الجانب العلمي الالكتروني لا الفقي القانوني، ثم دراسة جنحة التقليد، وذلك بالتطرق لأركانها. الكلمات المفتاحية: الملكية الصناعية، التصاميم الشكلية للدوائر المتكاملة، جنحة التقليد. Abstract: Industrial progress resulting from scientific and technological development has had a significant impact on the emergence of integrated circuit layout-designs, making it a key factor in strengthening the State’s industrial capacity, and because of its importance in the organization of economic relations, developed countries had to find a legislative system to ensure the protection of these patterns of configuration of integrated circuits and to contribute to the development of industry and trade Protecting the right of the innovator would stimulate innovation towards new models of integrated circuit layout-designs that would create economic enterprises contributing to the prosperity of trade. The layout plans (topographies) of integrated circuits, as well as other industrial property rights, enjoy criminal protection in the form of infringement proceedings, and According to Order No 03-08, any infringement of rights arising from these layout-designs shall be considered an infringement offence. In order to study criminal protection, the concept of layout designs (topographies) of integrated circuits, which are primarily scientific electronic rather than legal, should first be introduced, and then to study the infringement offence by addressing their elements.
