مدى نجاعة التصريح بالممتلكات في إثبات جرائم المتاجرة بالعهدات والوظائف العمومية

الملخص
إن تقلد المهام والوظائف والعهدات في مؤسسات الدولة، واستحداث المناصب العامة، يكون فقط بهدف تحقيق المصلحة العامة، ويحظر أن تكون هذه الوظائف مصدرا للثراء غير المشروع، ووسيلة لتحقيق المصالح الخاصة، وبهدف ضمان الشفافية في تسيير الشؤون العمومية، وأخلقة الوظائف والمهام العامة، وتعزيز قيم الشفافية والنزاهة، جاء المؤسس الدستوري والمشرع الجزائري، بالعديد من التدابير الوقائية في القطاع العام، ومن أهم هذه التدابير إجبارية التصريح بالممتلكات بالنسبة لكل شخص يُعيَّن في وظيفة عليا في الدولة، أو ينتخب أو يُعيَّن في البرلمان، أو في هيئة وطنية، أو ينتخب في مجلس محلي، والتصريح يكون في بداية وظيفته أو عهدته وفي نهايتها، وذلك قصد ضمان الشفافية في الحياة السياسية وتسيير الشؤون العمومية، وحماية الممتلكات العمومية، وضمان نزاهة وحياد الأشخاص المكلفين بخدمة عمومية (الأعوان العموميين). In a reality the assumption of tasks, jobs, and assignments in state institutions, and the creation of public positions, is only for the purpose of achieving the public interest, and it is prohibited for these jobs to be a source of illicit wealth and a means to achieve private interests, with the aim of ensuring transparency in the conduct of public affairs, creating public jobs and tasks, and promoting the values of Transparency and integrity, the constitutional founder and the Algerian legislator came with many preventive measures in the public sector, and among the most important of these measures is the compulsory declaration of property for every person appointed to a higher position in the state, or who is elected or appointed in Parliament, or in a national body, or elected in a council Local, and the permit is at the beginning of his job Or his custody and at the end of it, with the aim of ensuring transparency in political life and the conduct of public affairs, protecting public property, and ensuring the integrity and impartiality of persons charged with a public service (public servants).
