الملخص
تجميد أثر القوانين بسبب تأخر صدور التنظيمات Freezing of the effect of laws due to late issuing of reguatoy texts ملخص: إن القوانين و النصوص المصوت عليها في البرلمان هي تعبير عن السيادة الوطنية. و هي واجبة النفاذ. غير أنه من خلال فحص و دراسة العديد من النصوص يتبين أن هناك ظاهرة تفرض نفسها في الواقع، ألا و هي تعطيل القوانين و عدم تطبيقها في وقتها بسبب عدم صدور المراسيم التنفيذية التي كثيرا ما تنص عليها بعض أحكام النص لتحضير شروط و إجراءات التنفيذ . هذا الوضع راجع لعدم تقيد الحكومة بمدة لإصدار النصوص التنفيذية، مما أدى إلى عدم ظهور العديد من التنظيمات المتعلقة بكيفية تنفيذ و تفسير أحكام التشريع، فقد بقي القانون في أحيان كثيرة حبرا على ورق ليس له الفرصة ليرى النور، و تمر عليه السنوات بدون استعمال، و أصبح بذلك عدم صدور التنظيم عائقا كبيرا يواجه تطبيق قوانين الدولة . سيعالج هذا المقال سلطة الإدارة في إصدار النصوص التنظيمية، و كذا رقابة القاضي الإداري في هذا المجال. الكلمات المفتاحية : السلطة التنظيمية، القاضي الإداري، الفصل بين السلطات Abstract : Laws and texts voted on in pqrliament are an expression of national sovereignty;and they are enforceable;however; by examining and studying many texts ; it turns out that there is a phenomenon that imposes itself in reality; which is the disruption of laws and their non-appliction in time due to non- issuance of executive dccrees which often stipulate certain provisions of the text to prepare the conditions and methods of implementation This situation is due to the government’s non-compiance with a period for issuing executive texts; which led to the absence of many regulations related to implement and interpret the provisions of the legislation . The law has often remeaind ink on paper that does not have the opportunity to see the light ; and thus the lack of regulation has become a major obstacle faing the implementation of state laws. This article will deal with the authority of the administration in issuing regulatory texts , as the oversight of the administrative judge in this area.
