دراسة التأثير على البيئة كآلية لتطبيق مبدأ الحيطة

الملخص
إن اثبات عدم خطورة أي نشاط على البيئة والصحة الإنسانية، لا يتأتى إلا بإجراء دراسة لتقييم آثاره على البيئة، وفق قواعد وشروط محددة، ومسألة تحديد وتقدير درجة خطورة الضرر الذي من خلالها تتخذ التدابير الاحتياطية اللازمة تثير بعض الصعاب، إلا أن هذا التقدير نسبي وقابل للتطور وفق تطور العلم والمعرفة، حينئذ دراسة التأثير تعتبر وسيلة فعالة، تسمح بقياس درجة الخطر وتقدير الطابع اللارجعي للأضرار الناجمة عن النشاط المقترح، والتي قد تضر بالبيئة، وبالتالي هي آلية تلعب دور إيجابي في تسهيل تطبيق مبدأ الحيطة، الذي تم اعتماده من طرف عدة اتفاقيات دولية وحتى ضمن بعض التشريعات الوطنية . Summary: Proving the non-seriousness of any activity on the environment and human health can only be achieved by conducting a study to assess its effects on the environment, according to specific rules and conditions, and the issue of determining and assessing the degree of severity of the damage through which the necessary precautionary measures are taken raises some difficulties, but this assessment is relative and subject to development. According to the development of science and knowledge, then the impact study is considered a valuable tool that allows measuring the degree of risk and estimating the irreversible nature of the damages resulting from the proposed activity, which may harm the environment, and thus it is a mechanism that plays a positive role in facilitating the application of the precautionary principle, which has been adopted by several international agreements. And even within some national legislations.
