القرار الإداري الإلكتروني كأسلوب حديث لإدارة المرافق العمومية

الملخص
ملخص: في ظل التطور التكنولوجي الحاصل في التعاملات عن طريق استخدام الأسلوب الإلكتروني، وظهور ما يسمى بالرقمنة، لجأت أغلب المرافق العمومية مؤخرا إلى تكريس أساسيات الإدارة الإلكترونية في كافة تعاملاتها، والتحول من الإدارة التقليدية إلى الإلكترونية. وعلى أساس ذلك ظهر ما يسمى بالقرار الإداري الإلكتروني، وأصبح أهم وسيلة تلجأ إليه الإدارة قصد تسيير المرافق العامة، وتلبية حاجة الجمهور بصورة أفضل وأكثر سرعة وتطور. فالقرار الإداري الإلكتروني قد تكون له الأركان نفسها، لكن تفاصيلها تختلف عن القرار الإداري العادي، على عكس أحكام نفاذه التي تشهد العديد من الغموض خاصة في ظل غياب النص القانوني. Abstract: In light of the technological development taking place in transactions through the use of the electronic method, and the emergence of the so-called digitization, most public utilities have recently resorted to dedicating the basics of electronic management in all their dealings, and the shift from traditional to electronic administration. On the basis of this, the so-called electronic administrative decision appeared, and it became the most important means for the administration to resort to in order to run public utilities, and to meet the public’s need in a better, more rapid and advanced way. The electronic administrative decision may have the same pillars, but its details differ from the ordinary administrative decision, in contrast to the provisions of its enforcement, which witness many ambiguities, especially in the absence of the legal text.
