الملخص

يعالج موضوع البحث الاتفاقيات والصكوك الدولية التي صادقت أو انضمت إليها الجزائر المتعلقة مباشرة بالاستثمار الدولي من حيث الضمانات القانونية الممنوحة للمستثمر الأجنبي بموجب نصوص تلك الاتفاقيات. على اعتبار أن أي استثمار أجنبي يحتوي بشكل أو بآخر على حجم معين من المخاطر المادية أو القانونية ممثلة بشكل خاص في التغيرات التشريعية المستمرة في مقابل الاستقرار النسبي للنصوص الاتفاقية الدولية. سيما فيما يتعلق بتسوية النزاعات التي تطرأ بين المستثمر والدولة المضيفة. حيث يخلص البحث بعد معالجة هذه الاتفاقيات ومجال تطبيقها والضمانات التي توفرها الى اعتبارها ضمانا ومحفزا للاستثمار الأجنبي في الجزائر ينبغي استغلالها وتفعيلها لجلب الاستثمارات الأجنبية. Abstract: The topic of the research deals with the international agreements and instruments to which Algeria has ratified directly related to international investment in terms of the legal guarantees granted to the foreign investor under the provisions of those agreements. Given that any foreign investment contains a certain amount of material or legal risks represented in particular in the continuous legislative changes in exchange for the relative stability of the texts of the international agreement. Especially with regard to settling disputes that arise between the investor and the host country. Where the research concludes, after addressing these agreements and the scope of their application and the guarantees that they provide, that they are considered a guarantee and a stimulus for foreign investment in Algeria, which should be exploited and activated to attract foreign investments..
