التحليل الجنائي؛ اضطرابات المفهوم وتقييم الفعالية

الملخص
ملخص البحث: يتناول البحث إشكاليات التحليل الجنائي الموضوعية والمتمثلة في مفهومه أي من حيث تعريفه ووظائفه وأنواعه ومراحله وتطبيقاته، كدراسة نقدية، تنتهي بتقييم للتحليل الجنائي من حيث الفعالية رغم كل تلك الإشكاليات. انقسم البحث إلى أربعة مباحث، تناول المبحث الأول الإضطراب في تعريف ووظائف التحليل الجنائي، أما المبحث الثاني فتناول الإضطراب في تحديد أنواع التحليل الجنائي. المبحث الثالث تم تخصيصه لدراسة مراحل التحليل الجنائي، وانتهي البحث بمبحث رابع تناول دراسة نماذج تطبيقية يتبعها تقييم للتحليل الجنائي ومدى فعاليته. لقد تبين لنا من خلال البحث أن التحليل الجنائي نال تقييما مبالغاً فيه من قبل الباحثين، وأنه يحتاج للمزيد من التقييم الواقعي ليمكن تطوير أدواته. كما انتهى البحث أيضاً إلى ضرورة تطوير وحدات تحليل الجريمة، واقتراح إنشاء وحدات تنسيقية بين الشرطة والمحللين الجنائيين حتى تتم معالجة الإضطراب في العلاقة بينهما. انتهج البحث المنهج الوصفي التحليلي في المتن، ومنهج شيكاغو في التوثيق المرجعي. الكلمات المفتاحية: تحليل، جنائي، مفهوم، تقييم، فعالية. Abstract: The research deals with the objective problems of criminal analysis represented in its concept, i.e. in terms of its definition, functions, types, stages and applications, as a critical study, ending with an evaluation of criminal analysis in terms of effectiveness despite all these problems.The research was divided into four sections, the first section dealt with the disturbance in the definition and functions of criminal analysis, while the second topic dealt with the turbulence in determining the types of criminal analysis. The third topic was devoted to the study of the stages of criminal analysis, and the research ended with a fourth topic that dealt with a study of applied models, followed by an evaluation of criminal analysis and its effectiveness. We have found through research that the criminal analysis has received an exaggerated evaluation by researchers, and that it needs more realistic evaluation so that its tools can be developed. The research also concluded with the necessity of developing crime analysis units, and proposing the establishment of coordination units between the police and criminal analysts in order to address the disturbance in the relationship between them.The research adopted the descriptive analytical method in the text, and the Chicago method in reference documentation.
