زواج المراهقين Adolescent Marriage

الملخص
لقد حددت القوانين العربية سن الزواج، وبما أن المجتمعات عند العرب قد اعتادت على تزويج من هم دون السن المحددة قانونا لصحة العقد شرعا، فقد أجازت هذه القوانين زواج المراهقين بشرط موافقة الولي وإذن من القاضي إذا تحقق البلوغ الطبيعي، أما إذا تأخر البلوغ الطبيعي فيرى جمهور الفقهاء أن سن البلوغ لمن لم يبلغ طبيعيا هو السن الخامسة عشرة سواء بالنسبة للصغير أو الصغيرة وهو ما يسمى بالبلوغ التقديري أو الحكمي، ويشترط احتمال جسميهما، خاصة بالنسبة للمرأة إذ يشترط أن يتحمل جسمها الأعباء المنزلية والحمل وتربية الاطفال. وقد أجاز المشرع الجزائري زواج المراهقين بإذن من القاضي لمصلحة أو ضرورة بشرط تحقق القدرة الجسمية والمادية، ولكنه لم يحدد السن التي يسمح فيها بهذا الزواج وهو أمر غاية في الأهمية بالنسبة لزواج المرهقين، كما أنه من الأصوب أن يسن المشرع مادةً يحدد بها السن الذي يأذن فيه القاضي بزواج المراهقين. Arab laws have determined the age of marriage, but since their societies have been accustomed to marrying those who are under the legal age by the validity of the contract in Shariaa, This marriage is permitted on the condition of the guardian’s approval and the judge permission if natural puberty is achieved, but if it is delayed, the majority of jurists believe that the assumed age of puberty is fifteen, which is called judgmental puberty , where the endurance of their bodies is required, especially for a woman if able to bear the burdens of household, pregnancy and child rearing. The Algerian legislator has permitted the marriage of adolescents with the permission of the judge for necessity, provided that physical and material capacity is achieved, but it did not specify the allowed age of marriage, which is a very important for adolescent marriage, and more appropriate for the legislator to enact an article specifying the age that the judge authorizes the marriage.
