الملخص
الملخص: تساهم المؤشّرات الجغرافية بشكل كبير في التّنمية المستدامة، حيث استطاعت أن تتبوّأ مكانة عالية في مجال ترويج السّلع لدى كافة الدول التي تلعب فيها هذه الأخيرة دور المحتكر دون غيرها في الإستئثار بتلك الجودة وبالنظر لدورها الفعال فهي بمثابة وثيقة هوية تبرز المنشأ الحقيقي لمختلف السّلع، كما تعني كلّ مؤشّر يحدّد منشأ سلعة ما في أراضي بلد ما عضو في اتفاقية تريبس، حيث تعود النوعيّة والسّمعة أو كل السّمات الأخرى بصورة أساسيّة لتلك المنطقة، بالإضافة إلى أنّه لا يقتصر المؤشّر الجغرافي على مجرّد المنتجات الزراعيّة الفلاحيّة، بل يتعدّاها إلى منتجات الحرف التقليديّة والخدماتيّة في مجال السياحة ذات الطابع المميّز في مشملها. ويتجلّى الهدف وراء هذه الورقة البحثية في إعطاء تصوّر عام من خلال خصوصية ما تبنته اتفاقية تريبس كنظام دولي موضوعي يشجع روح المنافسة النّظيفة من أحكام، بإرساء أسس عامّة تحتمي المؤشّرات الجغرافية ذات الجودة العالية فيها تحت لواء ومضلّة قواعدها الحمائيّة، وفي إطار مختلف أجندة الحماية الجزائية والمدنية و الإدارية. Abstract: Geographical indications considerably contribute to sustainable development, seeing that they have been able to occupy a high position in the field of merchandize promotion in all countries in which these latter play the role of monopolist compared to others in monopolizing the said quality. More to the point, in view of its effective role, they represent an identity document that brings to light the true origin of various commodities; likewise, they stand for each indicator determines the origin of a particular commodity in the territory of a specific country that is a member of the TRIPS Agreement, whereat the quality, reputation, or each and every one of other characteristics are mainly related to that region. In addition, the geographical indication is not merely limited to agricultural products, but extends to products of traditional crafts and services in the domain of tourism as categorized by a distinctive character in its entirety. Indeed, the targeted purpose of this research paper is to confer a general perception throughout the specificity of the facts adopted by the TRIPS Agreement, as an objective international system encouraging the spirit of clean competition, in respect such as provisions that lay down general foundations whereat geographical indications of high quality are protected therein under the sign and cover of its protective rules, and within the scope of the various criminal, civil and administrative protection agendas.
