الملخص

على الرغم مما تشكله المحكمة الجنائية الدولية من تطور نوعي في نظام العدالة الجنائية الدولية وجميع الأنظمة القانونية العالمية المختلفة، بيد أنها تواجه جملة من العراقيل منذ تأسيسها. وجاءت هذه الدراسة لإبراز أهم الفواعل التي تحول دون فعالية هذه المحكمة في إنفاذ اختصاصها القضائي المكمل أصلا للولايات القضائية الجنائية الوطنية، سواء من حيث القيود القانونية التي تضمنها نظام روما الأساسي ونصوصه التي جاءت خادمة للأطراف دولية معينة أبدت تخوفها من إنشاء هذه الهيأة القضائية في مراحلها الأولى، والتي عرفت كيف تحمي نفسها من المتابعات التي يمكن أن تطال إحداها، فكان لها ذلك من خلال دباجة نظام روما الأساسي، أو من حيث السياسة الانتقائية لمجلس الأمن من خلال سلطتي الإحالة وإرجاء التحقيق، وتدخله في عمل هذه الهيئة تحت مسمى حق الفيتو. Despite the qualitative development of the International Criminal Court in the international criminal justice system and all the various international legal systems, however it has faced a number of obstacles since its establishment. This study came to highlight the most important factors that prevent the effectiveness of this court in enforcing its jurisdiction that is originally complementary to national criminal jurisdictions, both in terms of legal restrictions contained in the Rome Statute and its texts that came in the service of certain international parties that expressed their fear of establishing this judicial body in its early stages, which knew how to protect itself from the follow-ups that could affect one of them, and it did so through the preamble of the Rome Statute, or in terms of the selective policy of the Security Council through the powers of referral and postponement of the investigation and its intervention in the work of this body under the name of the right of veto.
