Developing A Drug Control System Using Human Rights Rules And Mechanisms

Abstract

The study aims at discussing the level of development that occurred in the drug control system, as it is not only a problem of individuals, but also of societies, their various environments, and its multiple economic, political, social, national and cross-border dimensions. These factors has forced states to shift away from their classic approach based on deterrence and punishment, towards flexibility and openness to human rights tools. The study concluded that the relationship of international human rights law with the legal system which is devoted to drug control showed a discrepancy in the proposal and objectives, which prompted countries to update their legislative policies in this field. The integration of the comprehensive assessment method into that system as provided by partnership and cooperation mechanisms became the appropriate formula, so that legal feasibility and procedural utility in drug control is achieved. تهدف الدراسة إلى مناقشة مستوى التطور الذي طرأ على منظومة مكافحة المخدرات باعتبارها ليست مشكلة أفراد فقط ، وإنما مجتمعات وفي مختلف بيئاتها وأبعادها المتعددة الاقتصادية، السياسية ، الاجتماعية، الوطنية منها والعابرة للحدود، الأمر الذي أصبح يفرض على الدول التحول عن منهجها الكلاسيكي المستند على الردع والعقاب نحو المرونة والانفتاح على أدوات حقوق الانسان ، وقد توصلت الدراسة إلى أن علاقة القانون الدولي لحقوق الانسان بالنظام القانوني المكرس لمكافحة المخدرات أظهرت تفاوتا في الطرح والاهداف ، مما دفع بالدول لتحديث سياساتها التشريعية في هذا المجال، كما أن ادماج أسلوب التقييم الشامل في تلك المنظومة وفق ما تتيحه آليات الشراكة والتعاون أصبح يشكل الصيغة المناسبة لتحقيق الجدوى القانونية والمنفعة الإجرائية في مكافحة المخدرات.
