الملخص
ملخص معاملة المدنيين في الحرب في الإسلام يتحدث البحث عن منهج الإسلام في معاملة المدنيين في الحرب، حيث بين في المبحث الأول مقارنة بين الحرب عند المسلمين والأمم الأخرى وانتهى إلى أن الحرب أمر طارئ لا يلجأ إليها المسلمون إلا بعد استنفاد كافة الطرق السلمية التي تحقق إعلاء كلمة الله تعالى ودخول الناس في دين الله عزوجل دون إكراههم على ذلك. وبين المبحث الثاني مفهوم المدني، والحربي، وبين أنه لا يجوز قتل النساء والصبيان في الحرب إلا عند اشتراكهم في ذلك، وأنه لا يجوز قتل أصحاب الأعذار المدنيين من غير النساء والصبيان مثل الشيخ الفاني، والأجراء، والرهبان الذين لا يخالطون الناس، والصناع والتجار وغيرهم إلا إذا ساعدوا في القتال أو حرضوا عليه. وتحدث المبحث الثالث عن الحالات التي يجوز فيها قتل المدنيين مبيناً أن ذلك أمر اقتضته الضرورة، وأنه مقدر بقدرها لا يتجاوزها، وأن لا يقصد قتل المدنيين وإنما مقاتلة المحاربين، ثم بين المبحث السبب في معاقبة الرسول صلى الله عليه وسلم لبني قريظة، وأن هذا العقاب إنما كان جزاء غدرهم وخيانتهم ونقضهم للعهد الذي بينهم وبين الرسول صلى الله عليه وسلم. الكلمات المفتاحية: الحرب، المدني، الحربي. ABSTRACT How To Deal With Civilians At War In Islam The first chapter makes a distinction between the concept of war in Islam and its concept in other nations. The chapter concludes that war is an emergency case and it is considered to be the last choice Moslems resort to after they run out of all peaceful solutions in order to up rise the word of God and encourage people to enter Islam without being forced. The second chapter distinguishes between the civilian and the military. It reveals that women and children must not be killed in time of war unless they participate in it. Also, people with certain excuses and civilians, rather than women and children, must not craftsmen, and others unless they have some kind of assistance during war-time or they are accused of inciting war. The third chapter covers certain cases where it is not permitted to kill civilians revealing that it is a necessity that is limited and should not exceed its limits, in other words, to fight against the worries and not to kill civilians. The chapter sheds light on the reason behind the worriers and not to kill civilians. The chapter sheds light on the reasons behind the Prophet's punishment for Bni Quraidhah which was inflicted on them because of their betrayal and breading their vows Prophet Mohammad (Peace Be Upon Him).
