الملخص

ملخص: تعد الحقوق والواجبات التي يتمتع بها عضو مجلس الأمة من الضمانات الأساسية لاستقلاله في آداء مهامه البرلمانية بكل فعالية، لذلك حددها الدستور ونظمها قانون عضو البرلمان والنظام الداخلي لمجلس الأمة من أجل فرض نظام وحماية خاصة للبرلمان كمؤسسة دستورية ولعضو مجلس الأمة كممثل للشعب. تهدف هذه الدراسة إلى ابراز أهم تلك الحقوق والواجبات التي يفرضها العمل البرلماني على عضو مجلس الأمة، والجزاءات المترتبة عل مخالفتها في إطار التعديل الدستوري الأخير والقوانين والأنظمة الداخلية المنظمة، حيث توصلنا إلى نتيجة مفادها إخلال عضو مجلس الأمة بواجباته البرلمانية يعرضه إلى تحمل جزاءات انضباطية، إضافة إلى تخلي المؤسس الدستوري عن حمايته جزائيا عن أفعاله المرتكبة خارج نشاطه البرلماني. Abstract: The rights and duties enjoyed by a member of the National Assembly are among the fandamental guarantees of his independence in the effective performance of his parliamentary duties. That is why the constitution defines them and regulated them by the law of the member of parliament and the internal system of the National Assembly in order to impose special order and protection for Parliament as a constitutional institution and for a member of the National Assembly as a representative of the people. This study aims to highlight the most important of those rights and duties imposed by parliamentary action on a member of the National Assembly, and the penalties for violating them within the framework of the recent constitutional amendment and the regulating internal laws and regulations. To the constitutional founder's relinquishment of his criminal protection for his acts committed outside his parliamentary activity.
