The Role Of States In The Application Of International Humanitarian Law Between Efficiency And Effectiveness

Abstract
Abstract Most States respect the norms of international humanitarian law by taking all necessary measures for the execution of their obligations as reflected in the Geneva Conventions of 1949 and the 1977 additional protocols, Yet the world continues to suffer from the effects of armed conflicts, both international and non-international, Many factors have contributed to the development of international humanitarian law . the change of the classic concept of war that has been between the borders of States and their regular armies has changed into the war on terrorism and evolved into cyber wars and the threat of epidemics like the Corona pandemic (Covid-19) and its variants. Future wars would be won in a laboratory, not on a battlefield. The application by States of the rules of international humanitarian law remains between the need to activate their role and the fact that their role is ignored. Keywords: International humanitarian law, the four Geneva Conventions, the Additional Protocols, terrorism, the fifth generation, cyber war. ملخص تحترم معظم الدول قواعد القانون الإنساني الدولي باتخاذ جميع التدابير اللازمة لتنفيذ التزاماتها على النحو الوارد في اتفاقيات جنيف لعام 1949 والبروتوكولين الإضافيين لعام 1977 ، ومع ذلك ، لا يزال العالم يعاني من آثار النزاعات المسلحة الدولية و النزاعات المسلحة غير الدولية، وقد ساهمت عوامل كثيرة في تطوير القانون الدولي الإنساني. تغير المفهوم الكلاسيكي للحرب التي كانت قائمة بين حدود الدول وجيوشها النظامية ليتحول إلى الحرب على الإرهاب ليتطور مفهوم الحرب إلى الحروب السيبرانية (الرقمية) وخطر انتشار أوبئة مثل وباء كورونا (Covid-19) و متحوراته. وستكسب الحروب في المستقبل في المختبر ، وليس في ساحة المعركة، ويبقى تطبيق الدول لقواعد القانون الإنساني الدولي بين الحاجة إلى تفعيل دورها وتجاهل دورها. الكلمات المفتاحية: القانون الدولي الإنساني، اتفاقيات جونيف الأربعة، البروتوكولين الإضافيين، الإرهاب ، الجيل الخامس، الحرب السيبرانية.
