الملخص
تهدف هذه الورقة البحثية، إلى تبيان آليات المشاركة الديمقراطية على المستوى المحلي باعتبارها حق من حقوق المواطن. لهذا نجد المؤسس الدستوري الجزائري كرّس المقاربة التشاركية صراحة في التعديلين الدستوريين لسنتي 2016 و2020، من أجل تفعيل وترشيد أداء الإدارة المحلية وتحقيق التنمية؛ إلا أنه عند دراستنا لآليات الديمقراطية التشاركية في قانون البلدية وبعض القوانين الخاصة اتضح أن ممارسة هذه الآليات تكاد تكون شبه منعدمة، وغير كافية ويكتنفها الكثير من الغموض، وعدم الوضوح، بالإضافة إلى عدم فعليتها وعدم الزاميها. ولهذا بات من الضروري الاهتمام بالمواطن، وتعزيز دوره في تسيير الشأن المحلي من أجل ترقية المقاربة التشاركية وتحقيق التنمية المستدامة. بالإضافة إلى رفع وعي الموظفين المحليين بحاجات المواطنين وانشغالاتهم. وتشجيع الديمقراطية الرقمية؛ ذلك أن دسترة آليات ممارسة الديمقراطية التشاركية المحلية في أعلى وثيقة والسمو بها، لا تعد كافية. فالأمر يستدعي من المشرع وضع نصوص واضحة وشفافة. وأن تتوفر إرادة سياسية قوية تسعى جاهدة لتفعيل النصوص، ووضعها حيز التطبيق. كلمات مفتاحية: الديمقراطية التشاركية؛ التنمية المستدامة؛ الإدارة المحلية؛ والمجتمع المدني؛ المواطن. Abstract: This research paper aims to show the mechanisms of democratic participation at the local level as a citizen's right. That is why we find the Algerian constitutional founder explicitly dedicated the participatory approach in the two constitutional amendments of 2016 and 2020, in order to activate and rationalize the performance of local administration and achieve development. However, when we study the mechanisms of participatory democracy in the municipal law and some special laws, it turns out that the practice of these mechanisms is almost non-existent, and these mechanisms are insufficient and shrouded in a lot of ambiguity, lack of clarity, in addition to their ineffectiveness and non-obligation. That is why it has become necessary to pay attention to the citizen, and to strengthen his role in managing local affairs in order to promote the participatory approach and achieve sustainable development. In addition to raising local employees' awareness of citizens' needs and concerns. Encouraging digital democracy, as constitutionalizing and elevating the mechanisms of practicing local participatory democracy in the highest document is not sufficient. It requires the legislature to put clear and transparent texts. And that there is a strong political will that strives to activate the texts and put them into practice.
