السلطة الوطنية المستقلة للانتخابات ورهان أخلقة الحياة السياسية

الملخص
لقد تم إنشاء السلطة الوطنية المستقلة للانتخابات لتحل محل السلطة التنفيذية في القيام بمهمة تحضير وتنظيم وتسيير العمليات الانتخابية، قصد ضمان شفافيتها ونزاهتها ومكافحة الفساد الانتخابي، والعمل على أخلقة الحياة السياسية، بحيث تهدف هذه الدراسة إلى معرفة مدى تمتع السلطة المستقلة بالاستقلالية اللازمة والصلاحيات الكافية في ممارسة المهام المنوطة بها، والتي تضمن شفافية ونزاهة العملية الانتخابية وصحة ومصداقية نتائجها، والتعرف على أهم العراقيل والعقبات التي تواجها في تحضير وتنظيم وتسير العملية الانتخابية وتؤثر على عملها وهدفها المتمثل في أخلقة العمل الانتخابي، بغيت إصلاح النقائص وسد الثغرات بما يمكنها من كسب ثقة الهيئة الناخبة والتقليل من ظاهرة العزوف الانتخابي. وقد تم التوصل في هذه الدراسة إلى أن السلطة الوطنية المستقلة للانتخابات مؤسسة دستورية مستقلة ذات طابع إداري، الذي يظهر من الصلاحيات والامتيازات التي تتمتع بها وخضوع أعمالها لرقابة القضاء الإداري، واحتكار رئس الجمهورية لصلاحية تعيين أعضائها، وفي إطار إبعاد السلطة التنفيذية من كل عمل من شأنه المساس بالعملية الانتخابية تم اسناد مهمة إصدار نصوص تنظيمية الخصاصة بها إلى رئيس السلطة المستقلة. Abstract: The Independent National Authority for Elections has been established to replace the executive authority in carrying out the task of preparing, organizing and conducting electoral processes, in order to ensure their transparency and integrity, combat electoral corruption, and work on the morality of political life, so that this study aims to know the extent to which the independent authority has the necessary independence and sufficient powers in exercising The tasks entrusted to it, which guarantee the transparency and integrity of the electoral process, the validity and credibility of its results, and identify the most obstacles that they face in preparing, organizing and running the electoral process and affecting its work and its goal of moralizing the electoral work From the phenomenon of electoral abstinence. In this study, it was concluded that the Independent National Electoral Authority is an independent constitutional institution of an administrative nature, which appears from the powers and privileges it enjoys and the subjection of its work to the oversight of the administrative judiciary, and the president’s monopoly on the power to appoint its members, and within the framework of excluding the executive authority from every work that would Infringement of the electoral process The task of issuing regulatory texts pertaining to it was assigned to the head of the independent authority.
