الإطار القانوني للأنشطة المتعلقة بالأسلحة والذخائر في التشريع المصري والتشريع الجزائري

الملخص
مادام أن الفرد يتمتع بحرية في حياته وتصرفاته وأن التشريعات الدولية والداخلية كفلت له ذلك، فإن هذه الحرية ليست مطلقة، وإنّما منضبطة ومنظمة بتشريعات حماية لبقية الأفراد الآخرين داخل المجتمع بغية الحفاظ على سلامة المجتمع وأمنه وصحته. ولذلك استدعى الأمر من الدول لتحقيق ذلك حماية النظام العام، من خلال تقييد بعض الحريات الفردية ومنعها أحيانا بل وتجريم بعض التصرفات لاسيما الماسة بعناصر النظام العام. ومادام أن الأنشطة المتعلقة بالأسلحة والذخائر تدخل ضمن هذه التصرفات بسبب خطورتها وحساسيتها، فلقد قررت العديد من الدول بما فيها مصر والجزائر اعتماد كأصل عام منع الأنشطة المتعلقة بها قانونا سواء تعلق الأمر بحملها أو نقلها أو استيرادها وصنعها، واستثناء أجازت إباحة التعامل بها في بعض الحالات وفق ضوابط قانونية قررتها من خلال فرض نظام الترخيص الإداري وفق شروط وإجراءات معينة في حالات محددة ولأشخاص معينين. As long as the individual enjoys freedom in his life and actions and that international and internal legislation guarantees him this, this freedom is not absolute, but rather disciplined and organized by legislation to protect the rest of the other individuals within the community in order to maintain the safety, security and health of the community. Therefore, states were required to achieve this to protect public order, by restricting and sometimes preventing some individual freedoms, and even criminalizing some behaviors, especially those affecting the elements of public order. As long as the activities related to weapons and ammunition fall within these behaviors due to their danger and sensitivity, many countries, including Egypt and Algeria, have decided to adopt as a general principle the legal prohibition of activities related to them, whether it is related to their carrying, transporting, importing and manufacturing, and with the exception of permitting their handling in some cases according to Legal controls decided by the imposition of the administrative licensing system according to certain conditions and procedures in specific cases and for certain persons
