جريمة التعدي على الملكية العقارية في التشريع الجزائري

الملخص
تهدف دراسة هذا الموضوع إلى حماية الملكية العقارية الخاصة التي حظيت باهتمام المشرع الجزائري من كل أشكال التعدي عليها، وكرسٌها الدستور الجزائري من خلال نص المادة 52 التي تنص على أن "الملكية الخاصة مضمونة " كما تضمنها قانون التوجه العقاري 90/25 من خلال نص المادة 28، وعرفها في نص المادة 27 منه، وقد بين هذا القانون الأملاك الوطنية العقارية، والملكية العقارية الخاصة، وتصنيف الملكية والقيود التي ترد عليها، فيهدف هذا القانون أساسا إلى استقرار الملكية العقارية وتوجيه كيفية استخدامها واستغلالها، ومن ثم كانت الحاجة الماسٌة إلى وجود قواعد قانونية زجرية تنظم الملكية العقارية وتضبطها، وتقوم بردٌع وزجٌر كل من يحاول التعدي عليها سواء كانت ملكية عامة أم خاصة من خلال نص المادة 386 من قانون العقوبات، وتوصلت الدراسة إلى اعتبار نص المادة 386 من قانون العقوبات النص العام والوحيد الذي جاء صراحة لكفالة الحماية الجزائية للملكية العقارية، بما يكفل استقرار المعاملات العقارية وحماية أصحاب الحقوق العينية، ويعزز الثقة فيما بينهم . The objective of this study is to protect the private property to which the Algerian legislature has been concerned from any form of encroachment , The main purpose of the Act is to secure and guide the use and exploitation of real property, It was stipulated in the Algerian Constitution through the text of Article 52, which states that private property is guaranteed as guaranteed by the Real Estate Orientation Law 90/25 through the text of Article 28 and defined it in the text of Article 27 of it . This law clarifies the national real estate, private real estate ownership , the classification of ownership and the restrictions imposed on it deters and rebukes anyone who tries to infringe upon it, whether it is public or private property, as stipulated in article 386 of the penal code The study concluded that the text of article 386of penal code is the general and only text for the sufficiency of penal protection for real estate ownership in order to ensure the stability of real estate transaction and the protection of rights holders in kind , it enhances trust among them Keywords : infringement ; Freedom ; Criminal penalty ; Real estate property ; Penal protection
