النظام الإنتخابي الجزائري وحمايته جزائيا في ظل الأمر 21-01

الملخص
يعتبر النظام الانتخابي في أي دولة من المعايير المهمة لدراسة توجه الدولة الديموقراطي . ومحافظة منها على النظام الانتخابي تسعى الدول إلى حمايته جزائيا عن طريق بسط الرقابة على جميع المراحل الانتخابية وبالتالي تجسيد الحماية الجزائية الشكلية والموضوعية على غرار تجريم الأفعال التي تؤثر على إرادة الناخب لكون الأصل هو حرية الانتخاب وهذا من خلال القانون العضوي رقم21 – 01المؤرخ في10 مارس 2021 المتعلق بنظام الانتخابات . من هذا المنطلق تهدف هذه الورقة من خلال منهج وصفي تحليلي الى ابراز أهمية العملية الانتخابية من جهة ، ونوع النظام الانتخابي المطبق في الجزائر ومدى تمتعه بالحماية الجزائية من جهة أخرى ، حيث تبنت الجزائر نظام التمثيل النسبي كنظام ديمقراطي ، كما تم بسط الرقابة على عملية الاقتراع من خلال الهيئة الوطنية المستقلة لمراقبة الانتخابات . The electoral system in any country is considered as one of the basic criteria for the study of the democratic orientation of the state. In order to preserve the electoral system, states seek to protect it on the penal plane by extending control over all electoral stages and thus embody formal and substantive penal protection similar to the criminalization of acts that affect the will of the voter as it is the essence of the freedom of voting, and this is implemented via the Fundamental Law No. 2101-of 10 March2021 related to the election system. From this point of view ,thispaper aims , through a descripitiveand analytical approach,to highlight the importance of electoral processon the one hand , the type of electoralsystem applied in algeria and the extentto which it enjoys conservatism protection on the other hand,where Algeria adopted the proportional representatio system as a democratic system ,and the supervision of the voting process was extended through the Independendent National Election Monitoring Authority .
