مآل السلطات الادارية المستقلة في الجزائر

الملخص
تهدف هذه الدراسة لتقييم تجربة السلطات الإدارية المستقلة في الجزائر، بالنظر لضعف ضمانات الاستقلالية وغموض التكييف القانوني لها، بالإضافة الى التحول من الضبط بواسطة سلطة إدارية مستقلة الى الضبط بواسطة الدولة في العديد من القطاعات في الآونة الأخيرة . ومنه طرحت الإشكالية الآتية: هل يعتبر هذا التحول مؤشرا على تخلي الجزائر على مفهوم السلطة الإدارية المستقلة؟ فكانت النتيجة أنه لا يمكن الجزم بتخلي الجزائر عن فكرة الضبط المستقل بشكل مطلق، بالنظر للاستمرار في انشاء هذه السلطات في قطاعات أخرى على غرار قطاع المحروقات، النشاط المتعلق بمعالجة المعطيات الشخصية والنشاط النووي، لكن تبقى مصداقية هذه السلطات في الجزائر محل تساؤل. This study aims to evaluate the experience of independent administrative authorities in Algeria, in view of the weak guarantees of independence and the ambiguity of their legal nature, especially after the transition from regulation by an independent administrative authority to the traditional state regulating in many sectors in recent times. From it, the following problem was raised: Is this transformation considered an indication that Algeria has abandoned the concept of independent administrative authority? The result was that it could not be certain that Algeria abandoned the idea of independent control absolutely, given the continuation of establishing these authorities in other sectors such as the hydrocarbon sector, the activity related to the processing of personal data and nuclear activity, but the credibility of these authorities in Algeria remains questionable.
