الملخص

ملخص: لقد ساهمت التطورات الاجتماعية إلى تغيير وظيفة الدولة فأصبحت موجهة، ومراقبة للنشاط الفردي، ومنه تم إنشاء أشخاص معنوية جديدة من بينها المنظمات المهنية، و أوجدت لهـــا هياكل تنظيمية، ومنه أثار أمر إنشائها إشكالات منها تحديد مكان تواجدها ضمن أشخاص القانون العام أو الخاص و كذا الاختصاص القضائي. إن البحث في الطبيعة القانونية لها بالغ الأهمية وهذا من خلال ازالة الغموض الذي يكتنفها في مجال القانون الإداري. Abstract: Developments that have affected all aspects of life have contributed to a change in the function of the State, which has become the initiator and controller of individual activity. Therefore, new legal entities, such as professional organizations, were created and provided with regulatory structures. The creation of these legal entities poses several problems such as the determination of their nature as legal persons under either public or private law and the related jurisdictional competence. The legal nature of the professional organization is a very important point in the research topic due to the ambiguity it presents in the field of administrative law
