مبادئ إبرام اتفاقيات تفويض المرفق العام: دراسة تحليلية في ضوء أحكام المرسوم الرئاسي 15/247 والمرسوم التنفيذي 18/199

الملخص
يعتبر تفويض المرفق العام أسلوب جديد في إدارة واستغلال المرافق العامة، وقد ظهر نتيجة التحولات التي شهدتها مختلف دول العالم ومنها الجزائر، خاصة في ظل انهيار أسعار البترول وتبني نظام الانفتاح على السوق، فكان لزاما على السلطة العامة مانحة التفويض أن تخضع اتفاقية تفويض المرفق العام قبل إبرامها لمجموعة من المبادئ الأساسية، ويتعلق الأمر بحرية الوصول إلى الطلبات العمومية، مبدأ المساواة أمام المترشحين ومبدأ شفافية الإجراءات، أما عند تنفيذها فإنها تخضع للمبادئ التقليدية التي تحكم سير المرافق العامة. تم تكريس مبادئ الإبرام من طرف المنظم الجزائري ضمن أحكام المادتين 05 و209 من المرسوم الرئاسي 15/247 المتعلق بالصفقات العمومية وتفويضات المرفق العام، والمادة 03 من المرسوم التنفيذي 18/199 المتعلق بتفويض المرفق العام. The delegation of the public utility is considered a new method for managing and exploiting public facilities, and it has emerged as a result of the transformations that have taken place in various countries of the world, including Algeria, especially in light of the collapse of oil prices and the adoption of the system of openness to the market, so the public authority granting the mandate had to submit to the public utility delegation agreement before Its conclusion is a set of basic principles, and it is related to freedom of access to public requests, the principle of equality before the candidates and the principle of transparency of procedures, but when implemented it is subject to the traditional principles governing the functioning of public facilities. The principles of the conclusion have been devoted by the Algerian organizer within the provisions of Articles 05 and 209 of Presidential Decree 15/247 related to public deals and public utility delegations, and Article 03 of Executive Decree 18/199 related to the delegation of the public utility.
