حماية حقوق المرأة في إطار قانون الأسرة الجزائري

الملخص
إن القانون الجزائري يسعى إلى حماية المرأة على جميع المستويات بما فيها مكانها الطبيعي ومحيطها الخاص وهو الأسرة، لذلك قام المشرع الجزائري بإجراء عدة تعديلات على قانون الأسرة بموجب الأمر 05/02، المؤرخ في 27 فيفري 2005، وتهدف هذه الدراسة إلى الوقوف على أهم هذه التعديلات التي مست هذا القانون باعتباره أهم قانون تناول حقوق المرأة، من خلال دراسة مدى حمايته لحقوق النساء، حيث تمحورت الإشكالية حول إلى أي مدى كرس قانون الأسرة الجزائري الحماية القانونية للمرأة ؟ وهل وفق في توفير الحماية اللازمة لها؟، و من أهم النتائج التي تم التوصل إليها هي أن هذه التعديلات حاولت تعزيز حماية المرأة وإضافة المزيد من المساواة بينها و بين الرجل، إلا أنها لم توفق في ذلك نظرا لعدم إمكانية تحقيق المساواة المطلقة بينهما، ذلك أن التطابق بينهما يعد أمرا مستحيلا لأن الله تعالى خلقهما مختلفين، ورتب على ذلك اختلاف بعض الأحكام لمصلحتهما، وليس تمييزا بينهما، من هنا تظهر ضرورة و أهمية مراعاة الشريعة الإسلامية في تنظيم حقوق المرأة. Abstract: The Algerian law seeks to protect women at all levels, including their natural place and their private environment, which is the family. Therefore, the Algerian legislator has made several amendments to the family law under Ordinance 05/02, dated February 27, 2005, and this study aims to identify the most important of these amendments. Which affected this law as the most important law dealing with women's rights, by studying the extent of its protection for women's rights, as the problem centered around the extent to which the Algerian family law has enshrined legal protection for women? And did he achieve the necessary protection for her? And among the most important results that were reached is that these amendments tried to enhance the protection of women and add more equality between them and men, but they did not succeed in that due to the inability to achieve absolute equality between them, so that The congruence between them is impossible because God Almighty created them differently, and he arranged for this to differ in some rulings for their benefit, and not to distinguish between them, hence the necessity and importance of observing Islamic law in regulating the rights of women.
