صلاحيات رئيس المجلس الشعبي البلدي في الجزائر و تونس - نموذجا

الملخص
البلدية هي الخلية الأساسية في اللامركزية الإقليمية، ونظرا لأهميتها بالنسبة لكيان الدولة و لهدف تقريب الإدارة من المواطن، منحها المشرع الجزائري و التونسي الشخصية المعنوية، من اجل إعطائها الحق في ممارسة كافة أنواع التصرفات القانونية في التعامل وفي اكتساب الحقوق و تحمل الالتزامات، كما يسهر على تسيير شؤونها مجلس شعبي بلدي منتخب من طرف سكان إقليمه و حدد لها رئيسا لتمثيلها. نظرا لأهمية منصب رئيس المجلس الشعبي البلدي الذي يعتبر المسؤول الأول عليها كونه ممثلا للهيئة التنفيذية وهمزة وصل بين المجلس الشعبي البلدي و الولاية خول له المشرع الجزائري وفقا للقانون 10– 11 المتعلق بالبلدية، و المشرع التونسي وفقا للقانون الأساسي عدد 29 لسنة 2018 متعلق بمجلة الجماعات المحلية صلاحيات واسعة باعتباره ممثلا للبلدية و ممثلا للدولة . الكلمات المفتاحية: رئيس المجلس الشعبي البلدي ، اختيار، صلاحيات ، الجزائر ، تونس. Abstract : The municipalityis the main cell in the regional decentralization , and givenits importance to the entity of the state and the aim of bringing the administration closer to the citisen , the algerian and tunisian legislators grantedher a legalpersonality , in order to giveit the right to practce all kinds of legal actions in dealing , acquiringrights and bearing obligations ,italsowatches over the conduct of itsaffairs by a municipal people’sassemblyelected by the residents of itsregion , and designated a head to representit . In view of the importance of the position of the president of the municipal people's concil ,whoisconsidered the first official responsible for it as a representative of the executive body and a linkbetween the people’sassembly and the state , the algerian legislator has authorizedhimaccording to the law 10 -11 pertains to the municipality , and the tunisian legislator according to organiclaw no . 29 of 2018 relatedto the local communitiescode , has broadpowers as a representative of the municipality and a representative of the state .
