ضوابط الطلاق الرجعي في التشريع الجزائري والعمل القضائي

الملخص
الملخص: إن واقعة فك الرابطة الزوجية تؤثر سلبا في وحدة الأسرة من حيث الزوجين أو الأولاد ، حيث أن الطلاق هو إحدى صور انحلال الزواج ، فمن نوعيه الطلاق الرجعي الذي يعتبر الأصل في الطلاق ، أما البائن فهو الاستثناء حيث تمحورت دراستي على مفهوم الطلاق الرجعي والضوابط التي تجعل من الطلاق رجعيا وليس بائنا بينونة صغرى أو كبرى ،كالدخول الحقيقي وانعدام العوض وعدم تجاوز الحد المشروع من عدد الطلقات .كما نعرج أيضا على الأثر المترتب على الطلاق الرجعي كالملك والحل وحق الرجعة ،ومدى اعتبار الحكم بالطلاق الرجعي منشئ أم كاشف وما يثار من إشكالات وتناقضات عن هذه المسائل في أحكام قانون الأسرة الجزائري وما جرى عليه العمل القضائي ، حيث نبين أهم الانتقادات و نقدم بعض النتائج والتوصيات في حدود الشريعة الإسلامية باعتبارها مصدر أساسي لقانون الأسرة في الجزائر Abstract: The dissolution of the marital bond adversely affects the family unit, particularly the spouses or children, asthe divorce per se is a form ofdissolution that fall intojust two: (i)a revocable divorce (raj'î), which is the ground for divorce, and (ii)anirrevocable divorce (bāʾin), which is the exception.The present paper focused on the concept of talaq raj'î and the rules that make the divorce revocable and not minor or majorirrevocable divorce (talaq ba'inbaynounasughra /or kubra), such as consummation of marriage, absence of considerationand non-triple repudiation (talaq thalatha).The effect of revocable divorce -such as bond, legal marriage(hil), and recourse-, the extent to which the pronouncement ofrevocable divorce is considered constitutiveor declaratory, and the problems and contradictions raised about these issues in the provisions of the Algerian family law and what the judicial work carried out to date were revealed.The most important criticisms were highlighted and the study results and recommendations were alsopresented within the limits of Islamic Law (Sharia’a) as the main source of Family Law in Algeria.
