الملخص
وردت في شأن حقوق الزوجة الثابتة لها بعقد الزواج بصفة عامة والمادية منها بصفة خاصة، العديد من النصوص والأحكام الشرعية، والتي جاءت في معظمها مقيدة بالعرف، كما وردت العديد من النصوص القانونية الوضعية التي تحيل إلى العرف والعادات لتحديد هذه الحقوق. نحاول من خلال دراسة موضوع أثر العرف على الحقوق المادية للزوجة، إيضاح العلاقة الموجودة بين هذه الحقوق والعرف، وذلك من خلال التطرق من جهة؛ إلى مدى مشروعية اللجوء إلى العرف لتحديد هذه الحقوق وعناصرها وتقديرها سواء في نظر الشريعة الإسلامية أو نظر القانون الوضعي، ومن جهة أخرى إلى كيفية تأثير الأعراف السائدة في المجتمع على حقوق الزوجات. There are many legal texts and rulings, most of which are restricted by custom, regarding the fixed rights of the wife through the marriage contract in general and the material ones in particular, as well as many positive legal texts that refer to custom and customs to determine these rights. By studying the subject of the impact of custom on the material rights of the wife, we try to clarify the relationship between these rights and custom, by addressing on the one hand; To the extent of the legality of resorting to custom to define and assess these rights, whether in the view of Islamic law or the statutory law, and on the other hand, how the prevailing norms in society affect the rights of wives.
