الملخص

من الدعوات التي يتداولها بعض الباحثين المعاصرين الدعوة إلى تخليص وتنقية التراث الفقهي من مسائل الرق والعبودية، وبالمناقشة العلمية الرصينة يتبين أنها دعوة صحيحة، لكن تحتاج لتحرير وتنوير وتحديد. فوجود مسائل الرق في كتب الفقهاء والتراث كان ظاهرة صحية أملاها النظام العالمي القديم. فينبغي التعامل مع وجود مسائل العبودية في الشريعةوفق مستويين: مستوى أنه من تاريخ التشريع قد وقع ومضى، فيُروى ويطوى. ومستوى أن هناك بناء فقهيا لا يزال قائما، فيه تأثير كبير لأحكام العبيد على المنظومة الفقهية، وهو المتعلق بقياس بعض مسائل الأحرار على أحوال العبيد. وعليه؛ فلا يمكن فصل هذا البناء بجرة قلم؛ بدعوى أن الرق قد ولّى، كما لا ينبغي إحياء ما اندرس من فقه العبيد وكأنهم لا يزالون بيننا اليوم. Among the calls that some contemporary researchers circulate is the call to purify and purify the doctrinal heritage from issues of slavery and servitude, and by discreet scientific discussion it turns out that it is a valid call, but it needs to be edited, enlightened and defined. The existence of issues of slavery in the books of jurists and heritage was a healthy phenomenon dictated by the old world order. The existence of issues of slavery in the Shari’a should be dealt with according to two levels: the level that from the date of legislation has occurred and has passed, then it is narrated and folded. And the level that there is a jurisprudential structure that still exists, in which the rulings of slaves have a great impact on the jurisprudential system, and it is related to the measurement of some issues of free men over the conditions of slaves. and accordingly; This construction cannot be separated with the stroke of a pen; On the pretext that slavery is over, and it is not necessary to revive what was taught about the jurisprudence of slaves, as if they are still among us today.
