الملخص
تبحث هذه الدراسة في مسألة كيفية تقدير التعويض عن الضرر التقصيري و ذلك بالمقارنة بين القانون العراقي و الانكليزي وذلك باستقراء النصوص القانونية والأحكام القضائية المتعلقة بالموضوع، وتحليلها، وكذلك المنهج المقارن للمقارنة بين موقفي القانون العراقيّ والقانون الانكليزي ، حيث تم البحث في ماهية التعويض و ما هي العناصر التي يشتملها و آلية و وقت تقديره في كل من القانونين و هل هناك طرق حسابية يعتمدها القاضي في اطار سلطته التقديرية لتحديد مقدار التعويض الممنوح ، و توصلت الدراسة لمجموعة من اوجه الشبه و الاختلاف بين القانونين في ذلك ، وخُتمت الدراسة بمقترحات تساعد في تنظيم مسألة تقدير التعويض عن الضرر التقصيري. Abstract This study researches the issue of how to estimate compensation for tortuous damage by comparing Iraqi and English law by extrapolating the legal texts and judicial rulings related to the subject, and analyzing them, as well as the comparative approach to compare the two positions of Iraqi law and English law, where the research was conducted on the nature of compensation and what they are The elements it includes and the mechanism and time of its assessment in each of the two laws, and are there arithmetic methods adopted by the judge within the framework of his discretion to determine the amount of compensation granted, and the study found a set of similarities and differences between the two laws in this issue, and the study concluded with proposals that help in organizing the issue of assessment Compensation for tortuous damage.
