الهدي النبوي بحسن الجوار في المفهوم الشرعي

الملخص
الملخــص: تناولت هذه الدراسة الهدي النبوي بحسن الجوار من منظور شرعي، هادفة إلى التعرف على المقصود بالجار وبيان حقوقه في المفهوم الشرعي من خلال تحديد أهمية الجوار وحقوقه والواجبات المرتبطة به والقواعد الأخلاقية الناظمة للتعامل معه في المفهوم الشرعي، ومن ثم بيان القيم وأثرها في بناء العلاقات بين الناس وخاصة الجيران، وقد بين الباحث طبيعة المنهج الشرعي في أهمية الإحسان إلى الجار في القرآن الكريم والسنة النبوية ومن ثم تنظيم القيم وأخلاقيات الجوار وكذلك أنواع حقوق الجار والنتائج والثمار المتعلقة بحسن الجوار في المفهوم الشرعي، حيث ظهر أن هناك عدة مظاهر قيمية وأخلاقية لحسن الجوار وأن عواقب متعددة بينتها النصوص الشرعية للإساءة إلى الجار وفق مظاهر وتفصيلات عالجتها هذه الدراسة. الكلمات المفتاحية: أخلاقيات، الجار، حقوق الجار، الهدي النبوي، المنظور الشرعي. ABSTRACT: This study dealt with the Prophet’s guidance on good neighborliness from a legal perspective, aiming to identify what is meant by the neighbor and clarify his rights in the legal concept by defining the importance of neighborhood and its rights and duties associated with it and the ethical rules regulating dealing with it in the legal concept, and then explaining the values and their impact on building relationships between people Especially the neighbours, the researcher explained the nature of the legal approach in the importance of kindness to the neighbor in the Holy Qur’an and the Sunnah of the Prophet, and then regulating the values and ethics of neighborliness, as well as the types of rights of the neighbor and the results and fruits related to good neighborliness in the legal concept. Several legal texts showed them to offend the neighbor according to the manifestations and details dealt with in this study.
