التقاضي الإلكتروني كآلية من آليات عصرنة قطاع العدالة

الملخص
بادرت الجزائر كغيرها من الدول في إطار عصرنة الإدارة، لتفعيل التكنولوجيات والإنتقال إلى رقمنة العديد من القطاعات، من أجل تحسين مستوى وجودة خدماتها. وقد شملت عملية الرقمنة قطاع العدالة باعتباره مرفق عام حيوي يقدم خدمات عمومية للمواطنين، وفي هذا الإطار أقر المشرع بآلية التقاضي الإلكتروني كأحد آليات العصرنة التي أتى بها القانون 15-03 المتعلق بعصرنة العدالة، وذلك من أجل تبسيط اجراءات التقاضي على المواطنين. وزادت أهمية التقاضي الالكتروني في ظل جائحة كورونا، التي فرضت الانتقال إلى التعامل الإلكتروني في إطار تطبيق الاجراءات الوقائية المتخذة لمواجهة الفيروس، والتي أدت إلى تعليق جميع الأنشطة، فأصبح قطاع العدالة يقدم خدمات رقمية لفائدة المتقاضين الأمر الذي أدى إلى سيرورة مرفق العدالة. الكلمات المفتاحية : التقاضي الإلكتروني، عصرنة العدالة، جائحة كورونا، المحاكمة عن بعد. Abstract: Ibad Algeria, like all other states in the framework of the modernization of the administration, to activate the technologies and the transition to digitization of many sectors to improve the quality of their services. The digitization process involved the justice sector, as a vital public facility providing public services to citizens, and in this context the legislator recognized the electronic litigation mechanism as one of the mechanismsof the era introduced by law 15-03 on the modernization of justice, in order to simplify the litigation procedures for citizens. The importance of electronic litigation increased in light of the corona pandemic, which forced the transition to electronic dealing in the framework of the application of preventive measures to counter the virus, which led to the suspension of all activities, the justice sector has come to provide digital services to litigants, leading to the progress of this facility key words: Electronic litigation, The modernization of justice, corona pandemic, trial remote.
