الملخص
مـلخـص: تسعى مختلف دول العالم إلى مكافحة ظاهرة الفساد، وذلك من خلال الانضمام إلى اتفاقيات دولية، واستحداث نصوص قانونية من أجل وضع حد لهذه الظاهرة أو على الأقل التقليل من انتشارها، و الجزائر من بين هذه الدّول التي كانت سباقة إلى المصادقة على اتفاقية الأمم المتحدة لمكافحة الفساد في سنة 2004، وتجسيدا لها أصدرت القانون 06-01، المتعلق بالوقاية من الفساد ومكافحته، بموجبه تم إنشاء الهيئة الوطنية للوقاية من الفساد ومكافحته، ذات صلاحيات مقيّدة، الشيء الذي حدّ من ممارسة مهامها. إن الانتقادات التي وجهت للهيئة الوطنية للوقاية من الفساد ومكافحته، وعدم تحقيقها للغرض الذي أنشئت من أجله، جعلت المشرع الجزائري يعيد النظر في المنظومة القانونية المنشئة لهذه الهيئة، من خلال دستور 2020، حيث قام بترقيتها من هيئة وطنية، إلى سلطة عليا للشفافية ومكافحة الفساد، وخوّلها صلاحيات واسعة من أجل ممارسة مهامها، هذا من جهة، ومن جهة أخرى تم اقتراح إستراتجية وطنية لمكافحة الفساد بمشاركة مختلف مؤسسات الدولة والمجتمع المدني لتفعيل مهام هذه الأخيرة. Abstract: Most ofcthe countries are seeking to combat the corruption phenomenon through adherence into international conventions ,and renew legal texts for the sake of putting an end to this phenomenon or at least reducing its spread. In 2004,Algeria was amongst the first countries to endorse the the United Nations convention to vombat corruption and thus the law 01-06 was issued, by which was created. The National commission to combat prevent against corruption, and to which were given restricted powers,the fact that limited exercising its duties. The criticism that was directed towards The National Commission for combating corruption and its failure to achieve the objective it was created for, made the Algerian project reconsider the legal system that created this commission through the 2020 constitution where it was upgraded to a supreme authority for transparency and combating corruption,entitled with wide powers to facilitate the execution if its functions all with proposong a national strategy to combat corruption with the participation of various international institutions and together with the civil society to activate its functions.
