الملخص

ملخص انتشر التعامل بالعقود التمويلية في المصارف الإسلامية بشكل كبير وواسع، حيث أن معظمها عقود مركبة في منظومة عقدية مترابطة ومتسلسلة يجري التواطؤ المسبق بين المصرف والعميل على إنشائها وإبرامها كالمرابحة للآمر بالشراء والمشاركة المتناقصة والإجارة المنتهية بالتمليك والتورق المنظم وغيرها، ورغم أن موضوع العقود المالية المركبة قد تم مناقشتها في المجامع والندوات الفقهية إلاّ أنها بحاجة إلى زيادة البحث والتوسع باعتبار أنها من المعاملات المستحدثة التي تتجدد صورها وأساليبها من وقت لآخر، ولذلك فقد ركّزت هذه الدراسة على حقيقة العقود المركبة من حيث مفهومها، وحالات اجتماعها، وأنواع المواطأة للجمع بينها، وصورها، وخصائصها، وأسباب اجتماعها، وأهداف الجمع بين العقود بحيلة أو ذريعة ربوية، وكذلك الوقوف على أقوال الفقهاء باختصار لبعض حالاتها، مع التركيز على ضوابط الجمع بينها، ثم الإشارة إلى بعض التطبيقات المعاصرة للجمع بين العقود وأحكامها العامة، وقد توصلت الدراسة إلى أنه يجب الأخذ بعين الاعتبار بضوابط الجمع بين العقود حتى تكون مشروعة ولا يترتب على التركيب توسل إلى ما هو محرم شرعًا. Abstract Combination of Contracts and Its applications in Islamic banks This study aims to shed light on Combination of Contracts in Islamic banks, where this type of contracts are undergoing a fast and wide, In fact most of these contracts take place in an connected and sequential contractual system leading to Advance Prior Agreement (Muwata`ah) between banks and customers to set up and endorse these contracts Instances of these contracts include, Murabaha to the purchase ordered, diminishing partnership, leasing ending with ownership, organized tawarruq, etc. Although the subject of Combination of Contracts has been discussed in jurisprudential councils and seminars , there is need to increase for more research and elaboration on the subject as there are still updated models of contracts appearing from time to time, This study focuses on the reality of Combination of Contracts by discussing the concepts on which they are built , the cases of their combination, types of complicity to combine them, their models, and their characteristics, reasons for their combination, the objectives of combining contracts with a trick or usurious excuse, as well as studying the sayings of the jurists briefly for some of their cases, with a focus on the controls of combining them, and then referring to some contemporary applications of combining contracts with their general provisions, The study concluded that these contracts must into account regulations so that the composition does not entail the invocation of what is forbidden according to Shariah.
