الملخص
تعتمد الإدارة المحلية في إنجاز مشاريعها التنموية على الصفقات العمومية، هذه الأخيرة تَضخُّ لها الإدارة أموالا ضخمة، مما يتعين ضرورة حماية هذه الأموال من الضياع، لذا فرض المشرع العديد من الآليات الرقابية على الصفقات العمومية حتى يوفر الحماية اللازمة للمال العام ويقضي على الصفقات المشبوهة، كما عمل المشرع على مكافحة الفساد من خلال القانون رقم 06-01 و المرسوم الرئاسي 15-247 ، واستحدث العديد من الآليات الوقائية منها سلطة ضبط الصفقات العمومية وتفويضات المرفق العام تتمثل الرقابة الإدارية على الصفقات العمومية في رقابة إدارية داخلية ورقابة إدارية خارجية، هذه الأخيرة تمارسها لجان منها اللجنة البلدية للصفقات واللجنة الولائية للصفقات، كما استحدث المشرع في المرسوم الرئاسي 15-247 سلطة ضبط الصفقات العمومية وتفويضات المرفق العام كآلية رقابية تهدف إلى الحد من الفساد في مجال الصفقات العمومية. The local administration relies on implementing its development projects on public deals, the latter of which the administration pumps huge sums into it, which necessitates protecting these funds from being lost, so the legislator imposed many control mechanisms on public deals in order to provide the necessary protection for public money and eliminate suspicious deals, as well as The legislator worked on combating corruption through Law No. 01-06 and Presidential Decree No. 247-15, and created several preventive mechanisms, including the authority to control public deals and public utility mandates. Administrative control over public deals is represented in internal administrative control and external administrative control, the latter being exercised by committees, including the Municipal Commission for Transactions and the State Commission for Transactions.
