الملخص
الفساد ظاهرة عالمية والجزائر شأنها في ذلك شأن غيرها من الدول لم تفلت من هذه الآفة، ولعل أهم مظاهرها اختلاس الأموال العامة ونهب الثروات وتعاطي مختلف التجاوزات كالرشوة واستغلال النفوذ والسلطة......إلخ. وقد لاقت هذه الآفة اهتماما من قبل المشرع الجزائري حيث قام بتعديل العديد من النصوص القانونية وإصدار الجديد منها بما يتماشى وتطوراتها، حيث أصدر القانون 06/01 المتعلق بالوقاية من الفساد ومكافحته استكمالا منه للمنظومة القانونية قصد التصدي لهذه الظاهرة التي تنخر هيكل التنظيم الإداري الذي يشكل عصب المجتمع. وقد حدد المشرع من خلاله مختلف صور التجريم وذلك بالنص على العقوبات المقررة لجرائم الفساد، غير أن المشرع أخرج كافة جرائم الفساد من دائرة الجنايات وأضفى عليها صبغة الجنحة دون الأخذ باعتبارات الخطورة والنتائج المترتبة عنها، فالقاعدة أن القاضي لا يمكنه الخروج عن النص القانوني في أحكامه، وهذا ما يجعله يقف عاجزا أمام أخطر الجرائم التي تعرض عليه.
