الأثار البيئية لجدار الفصل العنصري ومرتكزات المسؤولية الدولية

الملخص
من خلال هذه الدراسة تطرقنا إلى موضوع البيئة في فلسطين ومدى أهمية حمايتها من الإعتداءات الناتجة عن نشاط الإحتلال الإسرائيلي، ولا سيما الأثار السلبية المترتبه عن إنشاء جدار الفصل العنصري على البيئة في الأراضي الفلسطينية. وتكمن أهمية الموضوع من الناحية النظرية في النظر إلى الخلاف القائم بشأن اعتبار جدار الفصل العنصري جريمة بيئية، ومدى قيام المسؤولية الجنائية على القائمين على إنشاء جدار الفصل العنصري، للأهمية من الناحية العملية فهي تكمن في تكوين علم مسبق لدى جميع القانونيين الفلسطينيين حول المسؤولية الجنائية للاستيطان عن جدار الفصل العنصري والذي أدى إلى نشوء جريمة بيئية عن طريق تصرف استيطاني يهدف إلى نزوح الشعب الفلسطيني وبقاء الأرض لليهود. Through this study we mentioned the environment in Paestine and how important it is to protect it from Israeli occupation activities,especially the negative effects on the the environment at the Palestinian territories because of the aparthied wall . The importance of this subject theoritically is regarding the dispute if the aparthied wall was an environmental crime, and how the criminal responsibility is conducted upon the people in charge of building the aparthied wall, and practically the importance is based on establishing an advanced knowledge to all Palestinian Legal personell about the criminal responsibility regarding settlements being related to the aparthied wall which caused to a environmental crime by a settlement act that aims to the emigration of the Paestinian people and keeping the land for the Jews .
