الملخص
لقد حاولت من خلال هذه الورقة البحثية تسليط الضوء على تلك الجرائم البيئية العابرة للحدود كأحد أبرز الإفرازات السلبية للعولمة ، فالمفهوم الجديد للتنمية الاقتصادية و استغلال ما حصل من تحرّر اقتصادي في السنوات الأخيرة و التطورات غير المنضبطة المصاحبة للتقدم الصناعي،و فتح الحدود بين البلدان و اغتنام فرص العولمة بما يترتب عليها من تبعات هامة و انعكاسات سلبية على للبيئة قد أدى إلى بروز ظاهرة الإجرام البيئي كمشكلة دولية خطيرة من شأنها التأثير على اقتصاد البلدان و أمنها تأخذ أشكالا و مظاهر مختلفة و تشكل هاجساً عالمياً يحتاج الى حلول يغلب عليها الطابع العالمي وتحتاج الى تضافر الجهود، الأمر الذي دفع إلى ضرورة البحث عن آليات جديدة تتلاءم وطبيعة هذه الجرائم وتطوير الوسائل التقليدية بما يكفل تضامن جهود الدول وأجهزتها القائمة على مكافحة الجرائم عموماً والجريمة المنظمة على وجه الخصوص، من خلال الاتفاقات الدولية لمكافحة الجريمة البيئية العابرة للحدود والأجهزة المختصة بمكافحة الإجرام البيئي Abstract : I have tried through this paper to highlight the cross-border environmental crimes, regarded as one the most important negative effects of globalisation. The new concept of economic development and the exploitation of the achievements being endorsed by the economic independence which has characterized the past few years as well as the irregular progress that has associated the industrial development, the opening of borders between countries, seizing the opportunities stemming from globalisation including its considerable impact and negative consequences on environment, led to the phenomena of environmental crime, which should be considered as a dangerous problem spreading at the international level and likely to influence the economy and security of countries, under different shapes. This phenomenon is considered as a hobbyhorse of the whole world, requiring thus worldwide solutions and further efforts. That is why new mechanisms must be sought for, providing that they would be in harmony with the nature of crimes and develop the classical means so as to ensure the solidarity of efforts spared by the states and their authorities in charge of fighting crimes in general and the organised crime in particular, by concluding international agreements of fighting cross-border environmental crime as well as the mechanisms of fighting environmental crime Résumé : J’ai tenté à travers le présent exposé de faire la lumière sur les crimes environnementaux transfrontaliers considérés comme l’un des plus importants effets négatifs de la mondialisation. La nouvelle notion du développement économique et l’exploitation des réalisations consacrées par l’indépendance économique ayant marqué les dernières années ainsi que les progrès irréguliers qui ont accompagné le développement industriel, l’ouverture des frontières entre les pays, l’exploitation des opportunités de la mondialisation y compris son impact considérable et ses conséquences négatives sur l’environnement, a donné naissance au phénomène du crime environnemental qui est à considérer comme un problème dangereux sévissant au plan international et susceptible d’influencer l’économie et la sécurité des pays, en prenant de différentes formes . Ce phénomène est considéré comme le cheval de bataille du monde entier exigeant ainsi des solutions à caractère mondial et davantage d’efforts. D’où la nécessité de rechercher de nouveaux mécanismes qui seraient compatibles avec la nature de ses crimes et développer les moyens classiques de sorte à assurer la solidarité des efforts fournis par les états et leurs instances chargées de veiller à la lutte contre les crimes en général et le crime organisé en particulier , et ce à travers les conventions internationales de la lutte contre le crime environnemental transfrontalier ainsi que les mécanismes de la lutte contre le crime environnemental.
