حصانة المحامي في النظام القانوني الجزائري بين المطابقة والتفسير قراءة في قرار إحالة الدفع بعدم دستورية المادة 24 الفقرة الأخيرة من القانون 13-07

الملخص
تهدف هذه الدراسة لإبراز مدى مطابقة أحكام حصانة المحامي،خاصة تلك المكرسة في المادة 24 من القانون المنظم لمهنة المحاماة، للدستور، من خلال قراءة تحليلية لما تناوله قرار إحالة الدفع بعدم دستورية الصادر بتاريخ 28 مارس2021 ،كما تهدف إلى إعطاء تفسير قانوني للمادة 24 من خلال تحديد نطاق تطبيق هذه المادة ومن خلال البحث في فحواها وعدم التقيد بحرفيتها. توصلت الدراسة إلى أن حصانة المحامي ليست امتيازا شخصيا استثنائيا وإنما ضرورة مهنية عامة وأي مساس بها أو تقييدها أكثر هو مساس بالحق الدستوري للمتقاضي في الدفاع والاستعانة بمحامي وبالحق الدستوري للمحامي في منحه ضمانات قانونية تحميه وتسمح له بممارسة مهنته بكل حرية. كلمات مفتاحية: حصانة المحامي، حق الدفاع، الدفع بعدم الدستورية، المحاكمة العادلة، مهنة المحاماة. Abstract: This research aims to highlight to what extent the provisions of the immunity of the lawyer, in particular those enshrined in article 24 of the law regulating the profession of lawyer, are in conformity with the constitution, through an analytical reading of what has been dealt with the decision to refer the defense of unconstitutionality of March 28, 2021, and it also aims to give a interpretation of article 24 by defining the scope of this article and seeking its content. Research has concluded that attorney's immunity is not an exceptional personal privilege, but rather a general professional necessity, and any violation or restriction of this immunity constitutes a violation of the constitutional right to defend himself, and to request the assistance of a lawyer, and the constitutional right of the lawyer to grant him legal guarantees which protect him and allow him to freely exercise his profession.
