المسؤولية الجنائية عن إساءة استخدام الفايسبوك قضية جمال انموذجا

الملخص
على اثر التفتح الإعلامي ، وتدفقات الأنترنت ،وظهور وسائط الكترونية مختلفة ، من بينها الوسائط الالكترونية ذات الطبيعة الاجتماعية على شاكلة تويتر، انستغرام ، الفايسبوك ، وانتشر بالمفابل الاستخدام الواسع لها سواء لأغراض ترفيهية أو ترويجية ، وحتى تعليمية ،و بحسب ما فرضته كورونا اليوم من اقبال متسارع عليها، كون أغلب المستهلكين في هذا العالم الافتراضي يعتبرونها من أهم وسائل الترفيه. ومع حادثة مقتل الضحية جمال ، وما تم تداوله من فيديوهات وصور للواقعة هزت الرأي العام كبيرا وصغيرا ، وشغلته ،لدرجة تدخل ذات وسيلة الترويج للكشف عن المجرمين والمساعدة في تحقيق العدالة ولو بشكل بسيط وفي ظل هذا التطور الجرمي على مستوى الساحة الجنائية الجزائرية ، سارع المشرع الجزائري لفرض حماية أكثر من خلال اصدار الأمر 21/11 بشأن استحداث قطب جزائي وطني متخصص في المتــابــعــة والــتــحــقــيــق في الجرائـم المتصلـة بـتـكـنـولـوجـيـات الإعلام والاتصال والجرائم المرتبطة بها As a result of the media openness, Internet flows, and the émergence of varions electronic media, including electronic media of a social nature such as Twitter, Instagram, Facebook, and in turn, widespread use of them spread, whether for Entertainment or promotional purposes, and even educational, and according to what Corona imposed today from the turnout.
