أحكام وضوابط الوقف الإسلامي

الملخص
المستخلص: للوقف في الإسلام له آثار ومناقع اقتصادية واجتماعية كبيرة كالحد من التوسع في الثروات الخاصة، وتوجيهه إلى مصارف الخير المتنوعة. تتناول هذه الدراسة التأصيل الفقهي للوقف، واختلاف الفقهاء في تكييفه، وتصور حقيقته، والآثار التي تترتب على انعقاد الوقف من حيث اللزوم وعدمه، وحكم ملكية العين الموقوفة بعد وقفها. كما تهدف هذه الدراسة إلى التعرف على أبرز ملامح الوقف في الحضارة الإسلامية من خلال التعرف على أهم العوامل التي أثرت على الحركة الوقفية بها، ثم معرفة أنواع الوقف. وكنموذج من نماذج التطبيق الوقفي فقد ذكرت بعض الأمثلة للتنمية الاجتماعية الناتجة عن الاستثمار الوقفي في الإسلام كالمرافق الصحية والتعليمية والأكاديمية والاجتماعية. وخلصت هذه الدراسة إلى أن الوقف في الاشتقاق اللغوي يعني الحبس، أما في الاصطلاح الشرعي فيقصد به حبس العين على (حكم) ملك الواقف والتصدق بالمنفعة، وأن الطابع الديني هو الطابع الذي امتاز به الوقف في الإسلام. Abstract : Waqf in Islam has its economic and social many impact and benefits. For instances it limits the overspread of Private property. And directs the resources to charity. This researtch discusses the role of Alwaqf In social development since it is considered one of the most important social institutions in Islam that has an active role in organizing the society and running its affairs. This research aims to recognize the most common feature of the Waqf system in islamic civilisation, The research defines the most common element which influences the waqf movement at that time. It helps to define the different types of waqf. Also, the leadership and the contracts of waqf are like any professional enterprise and economic/financial institution. In addition, waqf creates various field s of investment, such as, property-renting. Waqf projects tackle public issues and equality and other social aspects of the Muslim World in general and the role of the waqf, particularly, in islam, as I mentioned in my research In conclusion the research result at The literal meaning of waqf is to stop and in Shariah it means to assign a property in the ownership of Allah in which the benefits are spent on those whom, that time characteristics by the religions stamp and most of the waqf had established around Quran Keywords : Waqf, Stop, charity which is continuing.
