الحماية الجنائية للمستهلك الإلكتروني وفكرة الأمن القانوني

الملخص
نظم المشرع الجزائري التجارة الإلكترونية بموجب القانون رقم 05/18 المتعلق بالتجارة الإلكترونية، وكرس عن طريق هذا القانون حماية جنائية للمستهلك الإلكتروني ضد السلوكيات التي قد يرتكبها طرف المورد الإلكتروني . لكن المنظومة العقابية المنوط بها حماية المستهلك الإلكتروني لم توفر له القدر الكافي من الأمن القانوني، ولاسيما في ظل إغفال المشرع الجزائري تجريم بعض السلوكيات التي تمس بأمن وسلامة المستهلك ومن قبيل ذلك جرائم الغش والخداع . وهو ما يتوجب معه عصرنة النصوص العقابية حتى تكون أهلا لمواجهة كل التحديات التي تواجه المستهلك الإلكتروني الذي اختار البيئة الرقمية كفضاء للحصول على السلعة أو الخدمة . Abstract : The Algerian legislator regulated electronic commerce under Law No. 05/18 related to electronic commerce, and established through this law criminal protection for the electronic consumer against behaviors that may be committed by the electronic supplier party. However, the punitive system entrusted with protecting the electronic consumer did not provide him with sufficient legal security, especially in light of the Algerian legislator’s omission to criminalize some behaviors that affect the security and safety of the consumer, such as the crimes of fraud and deception. Which is why it is necessary to modernize the punitive texts in order to be qualified to face all the challenges facing the electronic consumer who chose the digital environment as a space to obtain the good or service.
