دسترة الديمقراطية التشاركية في التجربة الجزائرية -الأبعاد و الرهانات-

الملخص
ملخص: سعى المؤسس الدستوري منذ الاستقلال إلى تأسيس إدارة محلية تشاركية وجعل الجماعات الإقليمية فضاء مفتوح للمبادرات العمومية المحلية، رغم أن الديمقراطية التشاركية أسست منذ الاستقلال سواء وفق ما يفرضه منطق ديمقراطية التسيير الذاتي، أو وفق ما أملته مبادئ الإيديولوجية الاشتراكية الاجتماعية في عهد الحزب الواحد، و كذلك الحال بالنسبة لمرحلة التعددية السياسية. إلا أنه رغم الإصلاحات المتعددة التي طالت نظام الإدارة المحلية خاصة منذ صدور قانون البلدية 11/10 الذي أرسى قواعد وآليات الديمقراطية المحلية قصد تجاوز الضعف في إمكانات البلديات البشرية و المالية، لم تستطع تجاوز أزمة التمثيل في المجالس المنتخبة و بناء إدارة محلية تشاركية أساسها مساهمة المواطن في بناء القرار العمومي المحلي. و عليه تأتي هذه الورقة لاستشراف مستقبل الديمقراطية التشاركية التي جاء بها الدستور المعدل في 2016 و أكدها دستور 2020 من خلال البحث عن أبعاد الدسترة و رهاناتها المستقبلية. Abstract In the aftermath of Algerian independence, the constitutional founder has tried to establish participatory local governance, in order to open up the public space for local initiatives, whether by Socialism principles or later by measures of political pluralism. However, the local management system has been affected intrinsically by different reform projects, especially when the communal law 10/11was adopted, new measures and the mechanisms has been set for local democracy, this new system allowed to surpass the financial and human resources deficiencies within municipalities, because it enables the whole system to go beyond of the democratic representative crisis, and establish a local administration based on the citizens' contribution to local public decision making partnership. Therefore, this study tries to explore the future of the participatory democracy in Algeria, since its adoption by the latest amendment of the Algerian constitution in 2016 and affirmed by the 2020, by taking into account the specification of the Algerian constitution and its future stakes.
