نحو تأطير العلاقات الجديدة بين العلوم والقانون وفق مقاربة بيوأخلاقية

الملخص
ملخص : أعادت جائحة كوفيد 19 للأذهان توترات قديمة بين المجتمع والعلوم، فالعلوم التي بطبيعتها وسيلة للمعرفة أصبحت مع مرور الوقت وسيلة للسلطة أيضا، وارتفع الاهتمام بالعلوم وأفل القانون في عالم اليوم الذي أصبح يستهدف كل مسببات التفوق والقوة مع إهمال واضح للحقوق، وتدعم هذا الاختلال بالتقنيات المتقاربة (النانو، البيوتكنولوجيا، الإعلام الآلي، العلوم المعرفية) التي أصبحت وسيلة مهمة لتحقيق درجات عليا من الرفاهية على حساب الإنسان كقيمة وكنوع وعلى حقوقه الأساسية وخصوصيته وكرامته. حاولنا من خلال هذه الدراسة تقديم مبررات قوية لتدعيم ومساندة البيوأخلاقيات، كمجال جامعي حديث يعمل في نهج متعدد التخصصات لإعادة التوازن في العلاقات بين العلوم والقانون من جهة، وبين العلوم والمجتمع من جهة أخرى، التكفل القانوني بحماية الاعتبارات البيوأخلاقية هو أهم وسيلة في رأينا لإعادة الثقة بين المجتمع والعلوم. Abstract: The Covid-19 pandemic recalled old pressures between society and science, which by its nature is considered as a mean of knowledge, it has become over time a mean of authority, therefore, he interests in science grew but it felt in law. Nowdays, which now targets all the causes of superiority and power with a clear neglect of rights, and this imbalance is reinforced by the convergence of technologies (nanotechnology, biotechnology, informatics, cognitive sciences), which has become an important means concerning the levels of well-being at the expense of the humans as a value and type and on its fundamental rights, privacy and dignity. Through this study, we tried to provide appropriate explanations to support and enhance bioethics, as a modern academic field that works in a multidisciplinary approach to restore the balance in the relations between science and law on the one hand, and between science and society on the other hand. Legal sponsorship to protect bioethical considerations is the most important way in our view to regain trust between society and science.
