Résumé
Résumé: L'universalité des droits de l'homme est apparue dans un monde caractérisé par la diversité culturelle, ce qui a conduit à des points de vue divergents sur la problématique de l'universalité et de la spécificité culturelle. Il y a ceux qui ont appelé à l'universalité des droits, à leur indivisibilité et à l'unification de leur application à toute l'humanité sans exception ni discrimination, en revanche de ceux qui appellent à l'application des droits de l'homme de manière cohérente et garantissant le respect des spécificités qui caractériser certains peuples et sociétés, Surtout les pays arabes et islamiques, afin de parvenir à la coexistence, à l'harmonie et à l'interdépendance des cultures et des civilisations. Cette étude traite la polémique sur la conciliation entre l'universalité des droits de l'homme et les spécificités culturelles qui caractérisent chaque société, à partir des différentes chartes et déclarations internationales. Selon une approche scientifique inductive en essayant d'extrapoler les textes juridiques contenus dans tous les accords internationaux et régionaux, et la méthode analytique à l'occasion de commenter ces textes et d'essayer de les analyser pour en tirer leur contenu. Abstract : The universality of human rights has emerged in a world characterized by cultural diversity, which has led to divergent views on the issue of universality and cultural specificity. There are those who called for the universality of rights, their indivisibility and the unification of their application to all humanity without exception or discrimination, on the other hand those who call for the application of the rights of the man in a coherent manner and guaranteeing respect for the specificities which characterize certain peoples and societies, especially Arab and Islamic countries, in order to achieve the coexistence, harmony and interdependence of cultures and civilizations. This study deals with the controversy over the reconciliation between the universality of human rights and the cultural specificities that characterize each society, based on the various international charters and declarations. According to an inductive scientific approach by trying to extrapolate the legal texts contained in all international and regional agreements, and the analytical method on the occasion of commenting on these texts and trying to analyze them to derive their content.
