أثر العقوبات الاقتصادية الدولية على الحق في التنمية

الملخص
يهدف موضوع الدراسة الحالية إلى البحث في العقوبات الاقتصادية الدولية والتي تعتبر من أهم المواضيع الراهنة المطروحة على الساحة الدولية، وذلك نظرا لأهميتها من جهة والآثار الناجمة عن تطبيقها من جهة أخرى، حيث تعتبر هذه العقوبات كآداة غير عسكرية يلجأ إليها مجلس الأمن للحفاظ على السلم والأمن الدوليين في حالة تهديدهما وفقا لما هو منصوص عليه في ميثاق الأمم المتحدة، لكن في المقابل تم التوصل إلى أن تطبيق هذه العقوبات ما هو إلى إهدار لحقوق الإنسان وخاصة الحق في التنمية نظرا لمكانته في إطار القانون الدولي، فإنه من الواجب الأخذ بعين الاعتبار هذا الحق عند فرض العقوبات الاقتصادية على دولة ما، وذلك بعدم تطبيق هذه العقوبات بطريقة تعسفية، تتنافى مع ما هو منصوص عليه في الميثاق. The subject of the current study aims to research international economic sanctions, which are considered one of the most important current issues on the international scene, due to their importance on the one hand and the effects resulting from their application on the other hand, as these sanctions are considered as a non-military tool that the Security Council resorts to to maintain international peace and security In the event of their threat in accordance with what is stipulated in the Charter of the United Nations, but on the other hand it was concluded that the application of these sanctions is a waste of human rights, especially the right to development due to its position in the framework of international law, it is necessary to take into account this right when imposing Economic sanctions against a country, by not applying these penalties in an arbitrary manner, which is incompatible with what is stipulated in the Charter.
